Participation Waiver

Grant of Rights. By participating in the Sea Level Rise Phone App and/or Catch the King community science / data collection events (collectively CTK) sponsored by Wetlands Watch (WW), each participant (or, in the case of a minor participant, the parent or legal guardian signing on behalf of such minor) irrevocably grants to WW the absolute and unrestricted right and permission to use, reproduce, publish, display, distribute, and create derivative works from any and all photographs, video recordings, audio recordings, digital images, or other visual or audio representations (Images) in which the participant appears, whether taken by WW or on its behalf during or in connection with CTK.

Release and Waiver. Each participant (or parent/legal guardian on behalf of a minor) releases, discharges, and holds harmless WW, its directors, officers, employees, volunteers, agents, successors, and assigns from any and all claims, demands, liabilities, causes of action, or damages of any kind arising out of or relating to the taking, use, reproduction, publication, distribution, or display of the Images.

Minor Consent. In the case of a minor participant (any individual under eighteen (18) years of age), the parent or legal guardian signing this waiver represents and warrants that they have full legal authority to consent to the terms of this clause on behalf of the minor. The parent or legal guardian agrees that this waiver is binding upon the minor and that they will not bring any claim or action on behalf of the minor that is inconsistent with the terms of this waiver.

Acknowledgment of Understanding. By signing below or by participating in CTK, each participant (or parent/legal guardian on behalf of a minor) acknowledges that they have carefully read this Release and Waiver, fully understand its contents, and voluntarily agree to be bound by its terms.
